ABATE of Arizona Chapters
ABATE is a voluntary organization.
The word "voluntary" is the key to a person's ability to succeed or fail as an
ABATE officer. Not only do you have to remember your time is given freely, but everyone you deal with in ABATE
also gives their time freely. Although a volunteer, if you run and are elected, you must be ready to accept
the responsibilities and perform the duties of that position. It is important to keep focused on the goals of
ABATE as an organization and to realize that NO ONE PERSON CAN DO IT ALONE. Each officer is but only a cog in
the wheel; when some of the cogs are broken or missing, the wheel cannot turn smoothly. It takes all of the
cogs!!
Each set of Officers should always keep in mind that they serve the membership. Additionally,
there is only one ABATE of Arizona; it is in all of our best interests to work together between the various
Chapters in the state to continue to strengthen ABATE and to bring motorcyclists together. We MUST all work
together!! Without the membership, the Chapters would cease to exist, as would ABATE, without the Chapters. On
the other hand, if ABATE fails, or meets its demise, so do the individual memberships and Chapters. It is always
a two-way street.

You might want to look at your license plate frames on all of your vehicles and
determine if you need to change or modify it to meet the new law. The following is the result of changes to Arizona
law effective January 01, 2009:
License Plate Holder Law - State law* requires that the state name at the top of Arizona license
plates must be visible. Any license plate holder or cover that prevents the license plate from being clearly legible,
is in violation of this new law. * A.R.S. 28-2354(B.)

In other words – the FREE Poker Run HAS TO BE ‘included’ in whatever your run is. By calling it a
Poker Run and charging for ‘entry’ to it is gambling.
Approximately 2 years ago, we were made aware that our Motorcycle Poker Runs, 50/50's and like Raffles,
were being closely scrutinized by the Arizona Department of Gaming (ADG). I’ve decided to print portions of my article again,
along with examples, as we are still violating Arizona gambling laws, in the way that we write some of our flyers!!!
What started this??? Legislative agreements from 2003, which had Arizona tribes pay millions of dollars,
for the 'Exclusive Rights' to gambling in this state. With no immediate dedicated law enforcement for these laws, complaints
were then handled by the police as they were made. BUT, as of 2 years ago, the ADG has been actively looking for and fining
those that violate these agreements.
They are not out to stop us completely, only to educate us on how to do them legally. IT IS ALL IN THE
WAY YOU WRITE YOUR FLYER !!!
The 'Ground Rules' for EVERYONE are:
-POKER RUNS:
You CANNOT legally receive monies from anyone, for the 'opportunity' to win cash and/or a prize. SO THE
POKER RUN HAS TO BE FREE – Period! You CANNOT charge for a Poker Run. You CANNOT specify Donations and then specify an Amount
to get around it. No matter what the run, if you specify a ‘donation’ for the entry to your run, you CANNOT specify an amount
along with it. You CAN charge for ENTRY to your event or for FOOD etc. So it would be best NOT to call your run a Poker Run
of any kind. Give your event a Name, charge for ENTRY and physically state “POKER RUN IS FREE”. There are NO exceptions to
these rules, even for 501 Tax Exempt Organizations.
** In other words – the FREE Poker Run HAS TO BE ‘included’ in whatever your run is. By calling it a Poker
Run and charging for ‘entry’ to it is gambling.
-50/50’s and RAFFLES:
IF you are a 501 Tax Exempt Organization AND have been such, at least 5 years prior to the Event - (i.e. ABATE/MMA) you can
run a 50/50 or Raffle legally.
IF you are NOT a 501, but the Proceeds are going to a CHARITABLE Organization, you MUST have persons from that CHARITABLE
Organization RUN THE 50/50 and/or Raffle for you. There are NO exceptions.
IF you are one of the clubs that is NOT of 501 status, and ABATE, MMA or another club with 501 status are physically “co-hosting”
the run, those organizations/clubs can run the 50/50 or Raffle for you.
IF your Club, Organization or Association is not a 501 and a 501 is NOT running them for you, you CANNOT legally conduct a
50/50 or Raffle PERIOD.
EXAMPLE:
Wrong - A recent flyer advertised “6th Annual Christmas Toy Run” – Poker Run Leaves …………… - Sign In
@ …………… - $10 per person or $15 per couple for donation for poker run.
Revision - “6th Annual Christmas Toy Run” – ENTRY for Toy Run $10 per person or $15 per couple – FREE
Poker Run Leaves @ ……………… - Sign in @ …………..
